These terms apply to your use of the Loami website, including joining the waitlist. Please read them before using the website. By using it, you agree to these terms.

1. Who we are

Loami is a trading name of FarmLink Capital (Pty) Ltd. In these terms, "Loami", "we", "us" and "our" refer to FarmLink Capital (Pty) Ltd, and "you" means anyone using the website.

These terms cover the website only. The Loami app will have its own terms of use, which you will be asked to accept when you create an account.

2. What Loami is, and what it is not

Loami is being built to help farmers organise and verify their farm data in a single Profile. This website tells you about the Loami app and lets you join the waitlist ahead of its launch.

Loami is not a credit provider under the National Credit Act, 2005, and is not a financial services provider under the Financial Advisory and Intermediary Services Act, 2002. Loami does not offer, arrange or advise on finance, insurance or any other financial product.

Nothing on this website is an offer of credit, a credit application, financial advice or a recommendation to take up any financial product. A stronger Profile does not guarantee that finance will be offered to you. Any decision to offer finance, and on what terms, is made solely by the finance provider concerned.

3. The waitlist

Joining the waitlist is free and places you under no obligation. It does not create a Loami account and does not guarantee access to the app on any particular date.

The launch date and the features described on this website reflect our current plans. They may change before or after launch, and we will keep people on the waitlist informed. You can leave the waitlist at any time by using the unsubscribe link in any email from us, or by emailing desk@loami.africa.

4. Using the website

You may use the website for lawful purposes only. In particular, you agree not to:

• sign up using an email address that is not yours or that you are not authorised to use;
• interfere with the website's security or operation, or try to gain unauthorised access to it;
• introduce viruses or other harmful code;
• copy or extract content from the website by automated means without our written permission.

5. Intellectual property

The Loami name, logo, design, text, images and other content on this website are owned by or licensed to us and are protected by law. You may view the website and share links to it, but you may not copy, adapt or use its content or branding for any other purpose without our written permission.

6. Information on the website

The information on this website is general information about Loami. We work to keep it accurate and up to date, but we do not guarantee that it is complete or free from errors, and it may change without notice. You should not rely on it as the basis for any financial or business decision.

We aim to keep the website available, but it may at times be unavailable because of maintenance or circumstances outside our control.

7. Links to other websites

Where the website links to other websites, those links are provided for convenience only. We do not control those websites and are not responsible for their content or their privacy practices.

8. Our liability

To the extent the law allows, we are not liable for any loss or damage arising from your use of, or inability to use, this website or from your reliance on its content.

Nothing in these terms limits any right you have under the Consumer Protection Act, 2008 or any other law that cannot lawfully be limited, and nothing in these terms excludes liability for our gross negligence or wilful misconduct.

9. Privacy

Our Privacy Policy explains how we handle the personal information you give us through the website, including your email address when you join the waitlist.

10. Changes to these terms

We may update these terms from time to time. The date at the top shows when they last changed, and continuing to use the website after a change means you accept the updated terms.

11. Governing law

These terms are governed by the laws of the Republic of South Africa, and the South African courts have jurisdiction over any dispute about them.
